2. Scope of this notice
This Privacy Policy covers personal data we handle in connection with:
- This website (boyemma.com) and any contact or inquiry forms or email links on it
- Customer and prospect inquiries, quotations, and commercial trucking / logistics work
- Hiring and careers (including driver and helper applications)
- Employment and crew administration for drivers, helpers, and staff, as needed to run the business lawfully
- Operational systems used to run trucking day to day — for example shipment documents, dispatch, fleet GPS for operations, and internal tools such as payroll or HR support systems
We are a trucking company, not an ad-tech platform. We do not run broad consumer marketing automation on this site. This notice stays high-level and honest about the data we actually need to move cargo, employ people, and answer the phone.
3. What personal data we collect
Depending on how you deal with us, we may process categories such as:
- Identity and contact data — name, company or organization, job title, phone numbers, email address, and similar details you give us
- Inquiry and communications content — emails, call notes, messages, quote requests, and the route/cargo details you share so we can answer you
- Customer and shipment / commercial data — booking or trip details, pickup and delivery points, cargo descriptions, proof of delivery and related shipment documents, billing and collections records, and counterparty contact details needed to complete a haul
- Employment application data — for driver, helper, and other candidates: application details, license information where relevant, work history, and supporting documents you submit (including through online apply links)
- Employment and crew records — for hired people, records required for labor compliance, payroll, benefits administration, safety, assignments, and day-to-day operations
- Fleet and operational location data — GPS and related fleet-tracking data used for dispatch, security, customer service, and service-level follow-through (not sold as a product)
- CCTV / premises security — we may operate cameras at yards or offices for security and incident review
- Website technical logs — basic server logs such as IP address, user agent, request path, and timestamps generated when you load pages on this site
Sensitive personal information
We only process sensitive personal information when the law allows it and the purpose requires it — for example government-issued IDs or other identity documents for employment, and health-related information only when needed for role fitness, safety, or a legal duty. We aim to collect the minimum needed and nothing extra for curiosity.
4. Why we use personal data (purposes)
We use personal data to:
- Respond to inquiries, quote requests, partnership checks, and website messages
- Provide trucking and logistics services — plan, dispatch, move cargo, document delivery, and support customer operations
- Recruit, hire, and employ drivers, helpers, and staff
- Support safety, security, accident response, claims handling, and yard/office protection
- Handle billing, collections, and related commercial administration
- Comply with Philippine law and lawful requests (including labor, tax, transport, and other regulatory duties)
- Keep this website and our systems reasonably secure and reliable
5. Legal bases and DPA principles
We process personal data in line with the Data Privacy Act principles of transparency, legitimate purpose, and proportionality. Depending on the situation, our processing may rest on one or more of the following:
- Consent — where the law requires consent, or where you clearly choose to give us information for a stated purpose
- Contract — to enter into or perform a contract with you or your organization (including carriage, commercial accounts, and employment)
- Legal obligation — to meet duties under Philippine law and lawful orders of competent authorities
- Legitimate interests — for example security, fraud and abuse prevention, fleet and yard safety, service quality, and ordinary business operations, balanced against your rights and freedoms
6. Who we share data with
We do not sell personal data. We may share personal data only as needed with:
- Our employees and authorized staff on a need-to-know basis
- Customers, shippers, consignees, and other counterparties when needed to complete a trip (for example proof of delivery and operational coordination)
- Government regulators and other authorities when required by law or lawful process
- Service providers and personal information processors who help us run the business — such as website hosting, email, IT support, GPS / fleet-tracking vendors, and payroll or similar internal tooling — under confidentiality and appropriate controls
We expect processors to use personal data only for the work we hired them to do, not for their own unrelated purposes.
7. Cross-border transfers
Some tools we use (for example cloud hosting, email, or software platforms) may store or process data on servers outside the Philippines. When that happens, we take reasonable steps to require appropriate safeguards and contractual controls from those providers, consistent with the Data Privacy Act and practical risk.
8. How long we keep data
We keep personal data only as long as needed for the purposes above, and for legal retention periods that apply to employment, tax, transport, commercial records, and claims. When data is no longer needed, we dispose of it securely or de-identify it where that makes sense.
9. Security measures
We apply reasonable organizational, physical, and technical measures to protect personal data against unauthorized access, use, loss, or disclosure. Access is limited on a need-to-know basis. No method of storage or transmission is perfectly secure, but we work to keep protections proportionate to the sensitivity of the data and the size of our operation.
10. Your rights as a data subject
Under the Data Privacy Act (including rights recognized under Section 16 and related rules), you may have the right to:
- Be informed about how your personal data is processed
- Object to certain processing, where the law allows
- Access personal data we hold about you, subject to lawful limits
- Correct or dispute inaccurate or incomplete personal data
- Erasure or blocking when applicable under the law (for example when data is incomplete, outdated, unlawfully obtained, or no longer necessary)
- Damages under the circumstances provided by law
- Data portability, where applicable and available for the type of processing involved
- Withdraw consent where processing is based on consent, without affecting processing already lawfully done before withdrawal
Some rights are not absolute. We may need to refuse or limit a request when the law requires us to keep records, protect others’ rights, or continue processing for a valid legal basis.
11. How to exercise your rights
To make a data privacy request:
- Email info@boyemma.com with the subject line Data Privacy Request, or
- Call 049 534 7005 / +63 49 534 7005
Please describe what you are asking for and enough detail for us to locate your records. We may need to verify your identity before acting. We aim to respond within a reasonable time and in line with National Privacy Commission (NPC) expectations and applicable law.
12. Children
This website is not directed at children under 18. We do not knowingly collect personal data from children through this marketing site. If you believe a child has provided us personal data through the site, contact us so we can review and delete it where appropriate.
13. Cookies and website technology
boyemma.com is a static marketing website. We do not currently run third-party analytics pixels or advertising trackers on this site. When you visit, our hosting environment may generate essential technical logs (such as IP address, user agent, and request data) needed to serve pages, maintain security, and diagnose problems. Any strictly necessary cookies or browser storage used by the site or host are for basic function and reliability — not behavioral advertising.
14. CCTV and fleet GPS
Fleet GPS supports dispatch, road and cargo security, customer service, and service-level follow-through. Location and trip data from fleet systems are operational tools for running trucking safely and on time. We do not sell that data.
CCTV may be used at yards or offices for security, incident investigation, and protection of people, units, and cargo. Camera use is for those operational and security purposes, not for secret marketing.
15. Automated decision-making
We do not use solely automated decision-making that produces legal or similarly significant effects about website visitors on this public marketing site.
16. Complaints to the National Privacy Commission
If you believe your data privacy rights have been violated, you may lodge a complaint with the National Privacy Commission. Learn more at privacy.gov.ph. We encourage you to contact us first so we can try to resolve the concern quickly.
17. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will post the revised version on this page and update the “last updated” date at the top. Continued use of our website or services after an update means the revised notice applies to later processing as stated.
